These Terms are the rules for buying a ticket or RSVP to a Circuit 909 event, coming to one, and using circuit909.com and our other pages. "Circuit 909", "we" and "us" means Circuit 909 Presents LLC, an Ohio limited liability company. "You" means anyone who buys, RSVPs, holds a ticket, attends, or uses our pages.
By buying a ticket, RSVPing, entering an event, or using our pages, you agree to these Terms and our Privacy Policy (circuit909.com/privacy), and you give us every permission in them, including permission to record you and use the recordings (section 9). If you buy for a group, you agree for everyone you buy for. If you don't agree, don't buy, RSVP or attend.
Please read section 17. Disputes are decided by an arbitrator, one person at a time, not in court or in a class action.
PART ONE: TICKETS AND EVENTS
1. Who sells your ticket
- We sell tickets and RSVPs through ticketing companies (for example Speakeasy or Posh). Their purchase terms also apply to your order. If their terms and ours conflict about the event (entry, conduct, recording, safety, refunds), ours control.
- Some events are co-presented with another promoter, a venue or a brand. If the co-presenter sells the ticket, its terms apply too, and these Terms still apply to everything we do at and around the event.
- Buy only through the links on circuit909.com, our social accounts, or the official seller for that event. We don't honor tickets bought anywhere else. Fake, duplicated or already-scanned tickets will be refused, and we won't replace them.
2. Your ticket is a license
- A ticket or RSVP is a revocable license to enter one event. It is not property. We or the venue may refuse entry to anyone, or remove anyone, for any lawful reason, without a refund.
- One ticket gets one person in once. Unless the event says re-entry is allowed, leaving ends your night.
- Transfers are allowed only through the ticket seller's own transfer tool, where it offers one. We may cancel, without a refund, tickets that were resold above face value, bought with bots or scripts, or bought over a ticket limit.
- Promo and ambassador codes are personal, can be changed or ended at any time, and can't be sold or stacked. We may cancel orders that misuse them.
- Prices change by tier and over time. We don't adjust past orders.
3. Free RSVPs
- An RSVP is required for entry to a free event. It doesn't guarantee entry.
- Free entry is first come, first served until the venue reaches capacity or the time on the event page.
- We may limit RSVPs per person and cancel duplicates.
4. All sales final
- All sales are final. There are no refunds or exchanges, including if an event is rescheduled, moved, shortened or cancelled, unless the law requires a refund or we choose to give one. Service and ticketing fees are never refunded.
- Rescheduled events. Your ticket is good for the new date.
- Venue changes. If the venue changes, your ticket is good at the new venue.
- Lineups, set times and set lengths can change at any time, including if an artist cancels or is replaced.
- Weather and safety. Events go ahead rain or shine. We or the venue may delay, pause, shorten or end an event for weather, safety, or anything outside our control.
- Chargebacks. If you dispute a charge for a ticket, table or RSVP instead of contacting us, we may cancel every ticket on that order, refuse your entry to future Circuit 909 events, and recover the disputed amount plus our fees and costs of collecting it.
5. Tables, bottle service and VIP
Table and VIP bookings follow the terms you're given when you book: the minimum spend, deposit, arrival time, and how many people are included. Deposits and minimum spends are non-refundable, including if your party arrives late, leaves early, or is refused entry or removed. A table not claimed by its arrival time may be released and resold. Bottle service and alcohol are sold by the venue under its license and Ohio law.
6. Age and ID
- Our events are 21 and over unless the event page lists a different age. A ticket for someone under the age limit won't be honored or refunded.
- Everyone must show a valid, unexpired, government-issued photo ID at the door, even if they look older. The venue decides which IDs it accepts. We or the venue may scan or record your ID.
- You may need ID again to buy alcohol, and the venue can refuse service at any time.
7. Search and prohibited items
You agree to be searched, along with your bags and belongings, as a condition of entry and at any time during the event. A search may include a pat-down, a wand or a metal detector. If you refuse, you won't be let in or you'll be removed, without a refund.
Not allowed in, unless the event or the venue says otherwise:
- weapons of any kind, or anything that could be used as one;
- illegal drugs and drug paraphernalia;
- outside alcohol, food or drinks;
- glass, cans, coolers and large bags;
- professional cameras, detachable lenses, audio or video recording gear, tripods, gimbals and live-streaming rigs (unless you are working media with our signed release);
- drones, laser pointers, fireworks, smoke or flares, confetti or glitter cannons, and noisemakers;
- flyers, samples or merchandise to hand out or sell, or promotion of any other event, brand or business, without our written permission;
- animals other than trained service animals.
Prohibited items will be refused or confiscated, won't be returned, and may be handed to police. No staff member can grant an exception that isn't in writing from us.
8. Conduct
- Treat everyone with respect: other guests, artists, staff, security and the venue. There is zero tolerance for harassment, unwanted touching, threats, violence, and discrimination of any kind.
- Follow the instructions of our staff, security, venue employees and police.
- No illegal drugs. No selling anything.
- Don't climb on stages, speakers, barriers or the venue's structures, and stay out of restricted areas.
- Staff or the venue may refuse entry or service to anyone who appears too intoxicated.
- No unauthorized commercial filming, sponsorship activity, sampling or promotion.
We decide what breaks these rules. We or the venue may remove you without a refund, ban you from future Circuit 909 events, share that with venues and other event organizers, and involve police.
If you or a friend feels unwell or unsafe, tell any staff member or security right away. Getting you help comes first.
9. Recording, photos and your likeness
Our events are recorded. By buying a ticket, RSVPing or entering, you give Circuit 909 permission to photograph, film and record you, and to use those recordings however we choose. Specifically, you agree that:
- What we can record: your image, likeness, appearance, voice, actions, and anything you say on camera, plus your name and social handles where we choose to tag or credit you.
- How we can use it: we may use, edit, crop, alter, combine with other material, publish, broadcast, stream, distribute, sell and license those recordings in any media and format, now known or invented later, worldwide, forever, for any purpose. That includes our social accounts, website, after-movies, live-set videos, advertising, sponsor and brand content, merchandise, and commercial products.
- Who can use it: we may share or license the recordings to anyone we choose, including co-presenters, artists, venues, sponsors, brand partners, media outlets and advertisers, and they may use them the same way.
- What you get: nothing. You won't be paid, credited, notified or asked to approve anything, and you can't take this permission back.
- Who owns it: we (or whoever we assign it to) own all recordings made at our events, including the copyright.
- What you give up: you release Circuit 909 and everyone using the recordings with our permission from any claim related to them, including claims for invasion of privacy, right of publicity, defamation, false light, moral rights, or the way a recording is edited or presented.
If you don't agree to be recorded, don't attend.
Your own photos and video. Phone photos and short clips for your own personal social media are welcome. You may not:
- live-stream or broadcast a set, or record an entire set;
- use recordings of the event, the artists, our production or the music for any commercial purpose;
- bring professional recording gear (section 7).
You give us a license to what you capture. For any photo, video or audio you take at our events that you post publicly, tag us in, or send us, you give Circuit 909 a free, worldwide, perpetual, irrevocable, sublicensable license to use, copy, edit, publish and distribute it in any media for any purpose, including advertising and sponsor content, with or without credit and without paying you. You confirm you have the right to give this license, including from anyone else who appears in it. We may ask you to take down content that breaks these Terms.
Media. Photographers, videographers and other media need our written approval and must sign our media release before they work an event.
10. Your health and safety
Live music events carry risks, including:
- loud music, which can damage hearing (we recommend earplugs);
- strobe lights, lasers, haze, fog, pyrotechnics and other effects, which can trigger seizures in people with photosensitive epilepsy;
- crowds, with pushing, bumping, spilled drinks and slippery floors;
- the conduct of other guests, and the effects of alcohol and other substances.
You attend voluntarily and accept all of these risks, known and unknown. To the fullest extent the law allows, you release Circuit 909, its co-presenters, the venue, the artists, sponsors, ticket sellers, and each of their owners, employees, contractors and agents (the "Released Parties") from all claims for injury, illness, death, loss or damage connected to attending, including claims based on the Released Parties' negligence.
If you need medical attention at an event, you consent to first aid and emergency care from on-site staff or emergency services, at your own cost.
We aren't responsible for lost, stolen or damaged belongings.
11. Accessibility
If you need an accessibility accommodation, email dance@circuit909.com before the event and we'll work with the venue.
PART TWO: OUR WEBSITE AND PAGES
12. Using our pages
- You may use circuit909.com and our pages for personal, non-commercial purposes. We may change or take down any page at any time.
- Don't scrape, copy or harvest our content or anyone's information; use bots or scripts to buy tickets or claim RSVPs; interfere with the site's security or operation; or use our pages for anything unlawful.
- Event details on our pages (lineups, times, venues, prices) can change. The ticket seller's checkout shows the current price and fees.
13. Our content
The Circuit 909 name and logo, our flyers, photos, videos, audio, designs and text belong to us or the people who licensed them to us. You may share our posts using the platforms' own share tools. You may not copy, edit, sell or use our content or brand commercially without our written permission. Anything you send us (ideas, feedback, photos, messages) we may use freely, without paying or crediting you.
14. Emails and texts
By buying a ticket or RSVPing, you agree that we may email you about our events, offers, partners and sponsors. You can unsubscribe from any marketing email. We text you only if you separately sign up for texts. Our Privacy Policy explains both, including STOP to end texts.
15. Other companies' sites
Our pages link to ticketing companies, Laylo and social platforms. Those are run by other companies under their own terms. When we sell merch, the store that sells it handles your order under its own terms and policies. We're not responsible for other companies' sites, services, products or conduct.
PART THREE: LEGAL TERMS
16. Limits on our liability
- Our pages and events are provided "as is" and "as available", without any promise beyond what these Terms say.
- We're not responsible for the acts of other guests, venues, artists, sponsors, ticket sellers or anyone else we don't control.
- To the fullest extent the law allows, we're not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, travel, hotel or other costs connected to attending or not attending an event.
- To the fullest extent the law allows, our total liability to you for all claims connected to an event or our pages is limited to the face value of the ticket you bought for that event.
17. Disputes
Notice first. Before starting any legal claim, you must email dance@circuit909.com with your name, how to reach you, what happened and what you want, and give us 30 days to resolve it.
One year. Any claim must be brought within one year after it arises, or it is permanently barred.
Small claims. Either side may bring an individual claim in small claims court in Franklin County, Ohio, if it qualifies.
Arbitration. Every other dispute about these Terms, a ticket, an event, a recording or our pages will be decided by binding individual arbitration with JAMS under its rules for consumer disputes (jamsadr.com), not in court. The hearing will be in Franklin County, Ohio, or by video. If 25 or more similar claims are brought by the same lawyers or in a coordinated way, they will be handled in batches under JAMS's mass-arbitration procedures. The arbitrator decides only your individual claim.
No class actions and no jury. You agree to bring claims only individually, not as a plaintiff or class member in any class, collective or representative action, and you waive any right to a jury trial.
Courts. If a claim isn't arbitrated, it will be heard only in the state or federal courts in Franklin County, Ohio, and you agree to those courts' jurisdiction.
Governing law. These Terms are governed by Ohio law, without regard to conflict-of-law rules. The Federal Arbitration Act governs this section.
18. You cover your own conduct
You will defend and cover Circuit 909 and the Released Parties against all claims, losses and costs (including reasonable legal fees) arising from your attendance, your conduct, anything you post or send us, or your breaking these Terms or the law.
19. General
- Changes. We may change these Terms at any time by posting a new version here with a new date. The version posted when you enter an event, or use our pages, applies.
- Events outside our control. We're not responsible for delays, changes or cancellations caused by weather, natural disasters, public-health orders, government action, power failures, venue problems, artist illness or travel problems, strikes, or anything else outside our reasonable control, and none of these entitle you to a refund.
- Severability. If any part of these Terms can't be enforced, it will be enforced to the fullest extent allowed and the rest still applies.
- No waiver. If we don't enforce a rule once, we can still enforce it later.
- Assignment. You can't transfer your rights under these Terms except through a permitted ticket transfer. We may transfer ours to anyone.
- Entire agreement. These Terms, our Privacy Policy, the event page, and any booking terms for your table or VIP package are the whole agreement between you and us about our events and pages.
